Father-Son Duo Sentenced After Violent Altercation Over Unpaid Wages

Richard and Shay Cassidy, from Swindon Road in Wroughton, were involved in a violent incident in Wantage in November 2021. In June, Richard Cassidy, aged 62, was found guilty at trial of causing grievous bodily harm with intent. His son, Shay Cassidy, 26, admitted to assault by beating on the first day of the trial.

On July 15, Richard Cassidy was sentenced to four-and-a-half years in prison, while Shay Cassidy received a 12-month conditional discharge.

The court heard that a verbal altercation erupted between Richard Cassidy and one of the victims over unpaid wages related to a bricklaying job. Shay Cassidy then pushed the man twice, leading to a fight on the ground.

Richard Cassidy intervened in the altercation, striking another man on the head with a knife. However, the extent of the victim’s injuries remains unclear, as he left the country shortly after the incident.

In mitigation, Kenniesha Stephens described Richard Cassidy as ‘remorseful’ and explained: “This is the first time in 62 years he finds himself in custody. He apologises for his actions that day.”

She continued: “The offence was not premeditated, nor was it in the heat of the moment. He believed that he and his son were under attack. He acknowledges the impact his actions have had. He has previously had a successful career as a bricklayer, which he knows is now lost.”

Ms. Stephens shared that Richard Cassidy had suffered two strokes and has a condition linked to dementia. She also spoke about his partner’s ill health and their plans to marry in Barbados. Despite this, Ms. Stephens emphasized his hard-working nature and standing as a well-respected figure, typically serving as a peacemaker.

The court was told that Shay and Richard Cassidy shared a household, with Richard handling most of the bills. Ms. Stephens noted that the sentence wouldn’t just affect Richard, highlighting delays in the case reaching trial.

Shay Cassidy had no prior convictions, and Ms. Stephens conveyed his understanding that his actions were wrong, describing it as a ‘one-off mistake’.

Judge Hassan Khan commented: “This incident occurred quite some time ago. There was an argument between the complainant and you, Richard Cassidy, over a non-payment. Shay Cassidy, you assaulted and pushed the man, while the other complainant fought with you. Richard then struck him over the head with a bladed article, consistent with a blow to the head. I’m told you are remorseful and apologise for this.”

In addition to the conditional discharge, Shay Cassidy was ordered to pay costs of £1,630.
